Privacy Policy and Community Rules

The Community is a place to discuss and share information, tips and other materials related to the Radio Chanson America service.
By using the Community, you agree to these Community Terms, Privacy Policy, and Guidelines.
These Terms constitute a legally binding agreement between you and Radio Chanson America, so please read them carefully. If you do not agree to the Terms, do not use the Radio Chanson America Community.
1. Community account
To use the Community, you must (1) have an existing Radio Chanson America account; and (2) create a “Community account” by following the instructions on the community registration page. You must ensure that your registration information is true, accurate and complete and keep it up to date. Radio Chanson America may reclaim or change your username at any time.
It is strictly prohibited to include in your profile any information that suggests that you are an employee or moderator of Radio Chanson America, or otherwise impersonate such an employee or moderator when using the Community.
2. No official support
Information, advice or other materials of any kind posted on Community Content do not constitute official endorsement provided by Radio Chanson America. For official support on billing and payment related issues, please submit a ticket to our customer service department client@chansonamerica.com using the registration form. You acknowledge that the opinions expressed in Community Content are solely those of the authors of such Content and do not reflect the opinions or policies of Radio Chanson America, its affiliates or companies.
3. Content, moderation and reporting
You are responsible for the weight of the Content you post in the community chats, Radio Chanson America does not control and is not responsible for such Content or any Content posted by other users.
Radio Chanson America reserves the right to moderate activity in community chats and may remove or edit any Content for any or no reason, including, without limitation, Content that, in Radio Chanson America’s sole discretion, violates these Community Terms. Radio Chanson America may remove such Content without prior notice to the responsible user.
Please be aware that using the Community in a manner inconsistent with any of the Terms may result in immediate termination or suspension of your accounts (see section“Term and Termination” below).
Please help Radio Chanson America protect the integrity of the community and ensure that the community remains as useful as possible by reporting any inappropriate user activity or postings within the community.
4. Recommendations
The integrity and safety of our Community and our users means a lot to us. To make the Community as effective and useful as possible, we expect you to abide by the community terms and rules.
5. Duration and termination of terms and conditions
These Community Terms will become effective against you when you create a Radio Chanson America Community Account and will remain in effect until you close your Radio Chanson America Community Account or are terminated by Radio Chanson America.
You can close your Radio Chanson America community account at any time from your mobile application profile. Without limiting its other rights to terminate access to the Community, Radio Chanson America reserves the right to terminate or suspend your Radio Chanson America Community Account at any time if, in Radio Chanson America’s sole discretion, you violate any of the Terms. If Radio Chanson America terminates or suspends your Radio Chanson America community account for any reason, Radio Chanson America will not have any liability to you.
6. No guarantee
Use of the Community is at your own risk. Community is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Radio Chanson America makes no warranties, express or implied, regarding the quality, content, availability or fitness for a particular purpose of the Community. In addition, Radio Chanson America does not guarantee, endorse, or assume responsibility for any Content posted on the Community or on any hyperlinked website. As with any information or advice obtained by any means or in any environment, you should use your own judgment and exercise caution when appropriate. No advice or information, whether oral or written, obtained by you from Radio Chanson America shall create any warranty on behalf of Radio Chanson America in this regard.
7. Limitations of liability
In no event shall Radio Chanson America, the officers, directors, employees, licensors of Radio Chanson America or any third parties be liable for any direct, indirect, incidental, special or consequential damages (including, without limitation, any loss of data, interruption of service , computer failure or property damage) arising out of the use of or inability to use the Community, even if you have advised Radio Chanson America of the possibility of such damages, including any resulting damages. Your sole right with respect to any problems or dissatisfaction with the Community is to close/delete your account and stop using the Community.
8. Compensation for damage
You agree to indemnify and hold harmless Radio Chanson America and its officers, directors, employees and licensors from any claim or demand (including, without limitation, reasonable attorneys’ fees) made by any third party due to or arising out of your violation of these Community Terms or the Rules, and or in violation of any laws, regulations or third party rights.
9. Intellectual property
Radio Chanson America respects intellectual property rights and expects you to do the same. Therefore, please note that the Community is the property of Radio Chanson America and its licensors and is protected by intellectual property rights (including, but not limited to, copyright), and that you may not use the Community in any way not permitted by these Community Terms.
10. Technological improvements and upgrades
Radio Chanson America will make reasonable efforts to maintain the functionality of the Community. However, certain technical difficulties or maintenance may result in temporary interruptions in service from time to time. Radio Chanson America reserves the right at any time or from time to time to modify or discontinue, temporarily or permanently, any of its features and functionality with or without notice. If Radio Chanson America modifies or discontinues the Community for any of the reasons set forth above in this Section 10, Radio Chanson America shall have no obligation or liability to you.
11. Confidentiality and User Data Policy
When you register to use the Community, Radio Chanson America and its hosting providers may collect, store, transmit and use your personal information. The privacy and security of your user data is and will remain Radio Chanson America’s highest priority.
Username and password are intended for personal use only and should be kept confidential
Radio Chanson America broadcasts live and actively engages with its audience. We conduct various quizzes and contests, therefore we may use the email address and username to communicate with the winners, send them prizes, and also provide our subscribers and users with special conditions for attending our offline events.
Users have the option to request the deletion of their account through the additional menu functions within the profile settings section. Alternatively, users can also contact the support team through the “Write to us” form available in the personal account dashboard.
Upon receiving a request for account deletion, we will proceed to permanently delete all associated user data from our systems. Please note that this action is irreversible, and once the account is deleted, all related information, including personal data and user-generated content, will be removed from our databases.
For any inquiries or assistance regarding account deletion, users can reach out to our support team through the provided communication channels. We are committed to ensuring transparency and facilitating user control over their personal information.
12. Miscellaneous
Radio Chanson America may change the Guidelines at any time in its sole discretion. You will be notified of any material changes, and your acceptance and/or continued use of the Community following such notice of a change will constitute your acceptance of such changes. Please do not use the Community if you do not agree to the new Terms.
Radio Chanson America may assign its rights and obligations under these Community Terms without restriction. You may not assign your rights or obligations regarding this Community or your Community Account or any part thereof to any third party.
The Community Terms and Conditions are governed by and construed in accordance with the laws applicable to you in accordance with the Radio Chanson America Terms of Use. Any dispute, controversy or claim arising out of or in connection with the Terms and Community Guidelines will be subject to the non-exclusive jurisdiction of a court or other tribunal.
